Students Win Reversal in Immigration Case in Ninth Circuit Court of Appeal
In the spring of the 2023-24 academic year, students in the Ninth Circuit Appellate Clinic won a reversal in an immigration case in the Ninth Circuit Court of Appeals. Daniel Lemer ’24 and Charles Pablico-Fernandez ’24 represented a Chinese immigrant who fled political persecution. After the client appealed pro se from the denial of asylum, the Ninth Circuit appointed the Clinic as pro bono counsel. The students filed an opening brief in the fall, a reply brief in the spring, and then delivered oral argument to a three-judge panel. Their impressive advocacy persuaded the court to reverse a decision from the Board of Immigration Appeals and to remand for further proceedings. The students were supervised by Mary-Christine Sungaila of Complex Appellate Litigation Group LLP and Professor Geoff Kehlmann.
