On Oct. 12, Professor John Nockleby was quoted by the Daily Journal regarding the potential effect in allowing trial court judges to examine the merits of a prospective class action before deciding whether to certify a class  in Supreme Court cases. In this story, he was quoted saying:

"Some judges refer to it as 'taking a peek.' You take a peek at the merits, and then you make that judgment."
